Ebay PAYS

Ebay has found in my favor as after investigating the matter it was determineted to be a fradulent or misrepresented lising/car


so $900.00 back in my pocket to pay for the repairs to the car.

only real loser here besides me is Ebay after all the seller got his money and kept it.

Ebay paid you because the Seller did not defend himself properly. Getting a check from eBay doesn't make what you did right. :o :o :o :o

yes it does, ebay wont pay unless they find after investigating the facts are that the car was either fraudulent or misrepresented

based on the listing of the car the emails i sent and recived to the seller where he addressed certain questions and made claims and the estimates from various repair shops.

interviews with the repair shops pictures sent...

they found in my favor.

I can take any OLD used car to ANY mechanic and get estimates for suggested services it needs. Any old car needs something.

I find it interesting that eBay paid out on this one. Actually it is a scary thought!

Lets say i list this old 92 Cavileer the wife has been driving on eBay and sell it. Good old car with 85k actual miles! probably worth 1500.00 or so. The buyer gets it and takes it to a buddy like you did, they come up with a grocery list of things that it needs, then file a fraud case with eBay and submit the receipts! What was a good old car to get back and forth to work is now grosley misrepresented! It needs new struts, brake rotors and drums are below min thickness, rack has a trace of fluid leaking out the seals, etc, etc, etc. And either I or eBay winds up giving the buyer $$$ that probably never spends it on the vehicle.

An associate has an old 77 Seville sold on eBay for 2200.00 He said everything but it was a POS and just an old car! Another personh filed a fraud complaint and eBay had him send 600.00 to settle the claim. Then the bidder left a neg after getting the check! That is a bunch of BS!!!

Fraud my ASS! If you bid and win Shit that is just what you get!

Doc why is it that you keep on trying to suggest I did the wrong thing? why is it you keep trying to say I ran some kind of scam?

man you are so negative.

first of all Ebay only covers the engine, transmission and frame damage that is undisclosed

your daily driver isnt gonna fly but the car i took to two different mechanics say mine had $2700.00 of engine repairs required.

I offered on several occasions to have you or anyone else to come look at the car, I wasnt trying to FLUFF or hide anything .. I offered to send the recipts and estimates to anyone...


Its all honest and above board here.

I find it interesting that every step of the way you have sided with the seller who has now been found by a nutral third party to have been in the wrong. It makes me question your motives

mmm my post got pink slapped cant figure that one out

some of you might rember me whineing about a pos Mazda I purchased. I
keept telling people the guy grossly defruaded/misreprested the car
but most of you said 'you got what you deserved etc etc etc

After filing with Ebay they found in my favor that the seller had
indeed defrauded/misreprested the car, and so I am pleased to post
here the out come.

this is the settlement i recived and I of course keep the car.

to those who feel they have been simularly cheated by a Ebay Motor
seller this is proof that there can be a legal means to reach
satisfaction.

Step one: inspect the car before buying you can save all sorts of
headaches if you jsut do this or have someone else do it for you.
Since most of us dont do step one...

step two: save all email corespondence you had with your seller and
be prepared to back up your case. Ebay will require estimates so its
best to go out to get them even if you have to tow the car (like i
had to). Remember you must show repiars required to the engine or
transmission or the body that were undisclosed that exceed $1500.00.
or proof the car was stolen or the title was either salvage, flood or
otherwise branded and undisclosed or proof of Odometer tampering
where the milage adjustment exceeds 50% of the value of the car (
personaly if the odo has been tampered with and not disclossed it
should be automatic fraud in my book but thats ebay for you)

once you have all your proof remember you can only make one claim
every 6 months wither or not its succesful so ask your self is this
really worth it? if it is you cant make your claim until 15 days
after auctions end so use this time to atempt a Square trade
mediation. if that takes care of your problem then thats great.

Assuming that ST didnt help and the 15 days has passed file with
ebay. once you ahve filed with ebay you have only 15 days to submit
all your documentation and proofs, which is why i suggested getting
it ready ahead of time. Be sure to provide pictures as well.

once they have all your stuff and they will email you the forms/fax
them or even over night them if need be. They attempt to contact the
seller to see what they have to say, its a second attempt of
mediation. The seller doenst have to do anything and its actualy
irrelevent ebay jsut trys to get out of paying by having the seller
and buyer reach an accord. this "mediation' period lasts about 5
working days. once thats done they compile all the facts and render a
decision within another 5 working days. Make a offer which you dont
have to accept feel free to counter offer until you reach an
agreement. once you do forms are sent out for you to sign and return.
a few days after that you recive your check.

So the system works. Rememebr time is of the essence you cant sit
around and wait, dont fix the problems and then make your claim
becuse if you do then it becomes a civil matter. it might take 30~45
days but its worth the wait

hehehe I honestly didnt think it should have mattered to them i blooted out the acount numbers etc. etc

they are a bit heavy handed with the censorship
