Folks, thanks for all the suggestions and some of the support. The mistake I made in this transaction is that I did not inspect the car (being in Columbus OH and car in Sarasota FL) under trust and sellers good previous feedback. At least, I probably should have gone to pick up the car myself at Sarasota rather than having it shipped so that I could have declined to accept it on seeing the misrepresentations. Now I am held up with this car that is needing significant money to even run safely.
On the chargeback of 10% Credit Card payment through PayPal, that still remains a possibility so that I can use the money for part of the repairs, but I am not able to make a decision. Infact, I was advised to do a credit card chargeback by Ebaymotors customer service rep. at livehelp for these misrepresentations. Kingrandyautomall or anyone else, have you ever done a charge back due to misrepresented item with PayPal or anybody else. Just want to know the possible problems it may bring about.

Doc is right on this one! Sometimes they feel like just a venue. Sometimes they don't. They will advise chargebacks if you make a complaint. They are very afraid of all of the class action lawsuits going around. It is the legal department's way of passing blame and coming out of their venue status when the opportunity presents it. It's go a little something like this. Hit it!

I wish we could get advice like this from ebay in writing. It would help in those class action suits. Ebay's just a venue stance does not hold up in court. Because the auction listings are stored on their server they are liable to a degree with the fraud that goes on there. Napster tried the we are only a venue stance and look where it got them. Have to thank Napster for opening ebay to either get sued or do something about what is going on there.
Sadly not one of the many auction sites I have checked out are much better. There is much that can be done that takes little effort. I see some of the smaller auction sites working to change. Sad the big corner of the market can't get the hint and do something as well.
